Bank Garnishments – Illinois – How Does It Work; What To Do

When a creditor obtains a money judgment against you they have  various collection techniques. If they find out that you have a bank  account or a credit union account they can proceed with a court order to  seize the money.

The  creditor can serve your bank with a garnishment or as now more common a  Citation to Discover Assets to a 3rd Party (your bank.) The citation  has advantages for them and disadvantages for you. AMOUNT THAT CAN BE FROZEN

LIMITATIONS

Certain funds are neither subject to garnishment nor citation:

  • Pensions (to the extent necessary for support)
  • Veteran’s benefits
  • Funds from the sale of a home or a personal injury settlement (subject to allowable exemption limits)

Federal  rules require banks to look back 60 days to find the source of the  funds and so inform the creditor that certain deposits are not subject  garnishment or citation. However, for various reasons bank often neglect  their duties. The point is that you must be vigilant. If the bank is  not following the rules you lose. WILL MY BANK CHARGE ME A FEE FOR A BANK GARNISHMENT AGAINST ME?

If  the only money in your account on the day of the bank’s review is from a  source that is automatically protected from being garnished, then there  are limits to what fees the bank is permitted to charge you. A bank is  allowed to charge you a garnishment fee only if funds which are not part  of a federal benefit payment are deposited into your account within  five business days after the account review. The garnishment fee also  cannot exceed the non-protected funds.

If  you have an amount of funds in your account that exceeds the amount of  automatically protected funds, then the bank may charge a garnishment  fee against that excess amount. DOES MY BANK HAVE TO NOTIFY ME WHEN IT RECEIVES A GARNISHMENT ORDER AGAINST ME?

If  you receive any type of federal benefit payments that are automatically  protected and you also have additional funds in your account that are  not automatically protected, then your bank must send you a notice  informing you that a court has issued a garnishment order against the  funds available in your bank account. This notice  will state the portion of money in your account that is automatically  protected from the garnishment.
